1. SCOPE

These Terms of Use apply to the use of the website at https://oguzhanarslan.com (including the portfolio pages, desktop interface, interactive tools and the Shop section). The site is operated by Oğuzhan Arslan, a natural person (the “Seller”). By using the site, you accept these terms. Purchases made in the Shop are additionally governed by the Pre-Contract Information Form, the Distance Sales Agreement and the Refund & Withdrawal Policy; in case of conflict, those documents prevail.

2. NATURE OF THE SITE

The site is a portfolio site presenting the Seller's work and services. The interactive tools, demos, sample content and projects marked as concepts on the site are for presentation and information purposes; unless expressly stated otherwise, they do not constitute an offer, a service commitment, a reservation or a client reference. Weather information is based on approximate location and is for information only.

3. SHOP

Seller and supplier: Oğuzhan Arslan. Payments are processed by Whop, our payment processor; Whop is not the seller or supplier. Whop may appear on your card statement.

The purchase is completed on this site: when you move to the payment step, an order number is created on the site, and Whop collects and processes the payment for the product price on the site under that order number. Whop is not the licensor of the products and services. The payment form may link to Whop's own terms; those terms govern your relationship with Whop, while the sales contract is concluded between you and the Seller and is governed by the sales documents on this site. A person making a purchase declares that they have the legal capacity to enter into a contract. Unless the product page states otherwise, purchased digital content is provided for your personal use as a non-transferable, non-exclusive right of use for the access period stated on the product page.

4. THIRD-PARTY SERVICES

Some features of the site use third-party services: Wikipedia search (Wikimedia Foundation), the music player (YouTube), weather data (Open-Meteo) and payments (Whop). The site is hosted on Vercel infrastructure and delivered through the Cloudflare network. Content from these services belongs to the respective rights holders and is subject to those services' own terms. The Seller does not guarantee the availability, accuracy or content of third-party services. Wikipedia content is displayed with its source credited and under its own licence.

5. INTELLECTUAL PROPERTY

Unless stated otherwise, the design, texts, images, software and other content of the site belong to the Seller or the respective rights holders and are protected by applicable law, in particular Law No. 5846 on Intellectual and Artistic Works. Apart from personal, non-commercial viewing, this content may not be reproduced, distributed or used for commercial purposes without the Seller's written permission. Third-party trademarks, logos, icons and product names appearing on the site belong to their respective owners; their use does not imply any partnership, sponsorship or endorsement.

6. RULES OF USE

You agree to use the site lawfully and in accordance with these terms. Attempts to disrupt the operation of the site, circumvent security measures or request limits, gain unauthorised access to the admin panel, send automated queries that overload the site, create orders in bulk or by automated means without the intention to buy, or share purchased digital content or access details beyond the scope of use stated on the product page are prohibited.

7. LIMITATION OF LIABILITY

The site and its free tools are provided as they are; the Seller does not undertake that they will operate without interruption or error. Without prejudice to the Seller's liability for intent and gross negligence, liability that cannot be limited by law, and consumers' rights under mandatory law, the Seller is not liable for indirect damages arising from the use of the free parts of the site. Liability for purchased products and services is governed by the relevant sales documents and applicable law.

8. LINKS

The site may contain links to third-party sites. The owners of those sites are responsible for their content and privacy practices.

9. CHANGES

The Seller may update these terms. The current version takes effect when it is published on the site; changes do not affect sales contracts concluded before publication. Each order is governed by the version of the documents approved at the time of the order.

10. GOVERNING LAW AND DISPUTES

These terms are governed by the laws of the Republic of Turkey. Consumers may apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or, under the conditions set out in Law No. 6502, to the Consumer Courts (Tüketici Mahkemeleri). The rights of consumers resident outside Turkey under the mandatory provisions of their country of residence, and their right to apply to the courts of their place of residence, remain reserved. Disputes with users who are not consumers are subject to the general rules on jurisdiction.

This text is published in Turkish and English. If the two versions differ, the Turkish version prevails; this does not limit the rights a consumer has under the mandatory provisions of the law of their place of residence or the principle that unclear terms are interpreted in the consumer's favour.
