ARTICLE 1 – PARTIES

Seller and supplier (a natural person selling as an individual seller; the “Seller”):

Full name: Oğuzhan Arslan
Address (for contact and service of notices): Şile/istanbul
Email: info@oguzhanarslan.com
Phone: +387 62 903 669

Buyer: the person who places an order in the Shop section at https://oguzhanarslan.com (the “Buyer”). The Buyer's contact details are those entered in the Whop payment form in the site's payment step. A Buyer acting for purposes outside their trade or profession is a consumer within the meaning of Turkish Consumer Protection Law No. 6502.

Payments are processed by Whop, our payment processor. Whop is not a party to this agreement; it is not the seller or supplier.

ARTICLE 2 – SUBJECT

The subject of this agreement is to set out, in accordance with Law No. 6502, the Distance Contracts Regulation and Law No. 6563 on the Regulation of Electronic Commerce, the rights and obligations of the parties regarding the sale and performance of the digital product or service ordered electronically by the Buyer, whose characteristics and sales price are stated on the product page and in the order summary and recorded under the order number. The Pre-Contract Information Form is an integral part of this agreement.

ARTICLE 3 – PRODUCT OR SERVICE AND PRICE

The name, main characteristics, access or service period and delivery (performance) method of the product or service are the details shown at the time of the order on the product page and in the order summary above the payment form; these details are copied into the order record, as they stand at that moment, together with the order number created when the Buyer moves to the payment step. Each product is offered for a specific access or service period. The price is the product price on the site; it is shown on the product page and in the order summary as the total price including all taxes, with its amount and currency, and no tax or other charge is added to it at checkout. Whop processes the payment for that amount and currency, as in effect when the order number is created, under the site's order number. The same amount and currency are shown in the summary of the Whop payment form immediately before the Buyer commits to pay, and appear on the payment receipt. If the amount charged differs from the price shown on the site, the amount more favourable to the consumer applies and any excess is refunded. No delivery or shipping fee is charged.

ARTICLE 4 – PAYMENT

Payment is made in full and in advance at the time of the order using the payment methods offered in the Whop payment form that opens in the site's payment step; there are no instalment sales or automatically renewing subscriptions. When the Buyer presses “Continue to payment”, an order number is created on the site; this step does not create an obligation to pay. The Buyer places the order by pressing the final confirmation button in the payment form, and the order creates an obligation to pay. An order whose payment is not completed creates no obligation for either party.

Seller and supplier: Oğuzhan Arslan. Payments are processed by Whop, our payment processor; Whop is not the seller or supplier. Whop may appear on your card statement.

Whop may appear as the payment party to the transaction for the purposes of card network rules and payment settlement; this does not make Whop the seller or supplier under this agreement. The Buyer's card details are entered in the Whop payment form and are not shared with the Seller. The receipt Whop sends to the Buyer's email address confirms that the order has been received; any invoice or document required by law is issued separately by the Seller.

ARTICLE 5 – DELIVERY AND PERFORMANCE

The Seller performs the product or service in accordance with the characteristics and delivery method stated on the product page at the time of the order, using the email address the Buyer provided in the payment form. Performance of digital content and services marked as delivered instantly begins immediately after the payment is confirmed. Other products and services are performed within the period committed on the product page or, if no period is stated, no later than thirty days from the date the order reaches the Seller.

If the Seller does not perform within this period, the Buyer may terminate the agreement; in that case the Seller refunds all payments received, together with statutory interest, within fourteen days from the date the termination notice reaches the Seller. If performance becomes impossible, the Seller informs the Buyer in writing or on a durable medium (for example, by email) within three days of learning of this and refunds all payments received no later than fourteen days from the date of that notice.

ARTICLE 6 – RIGHT OF WITHDRAWAL

The Buyer may withdraw from the agreement within fourteen days without giving any reason and without paying any penalty. The withdrawal period begins, for service contracts, on the day the contract is concluded and, for the sale of intangible goods such as digital content, on the day the content is delivered to the Buyer.

The withdrawal notice is given before the period expires by email to info@oguzhanarslan.com or in writing to Şile/istanbul. The Seller confirms by email that the notice has been received and refunds all payments received no later than fourteen days from the date the notice reaches the Seller, via Whop, to the payment method used, in a single transaction and without charging the Buyer any cost. Exercising the right of withdrawal also ends any ancillary contracts linked to this agreement, at no cost to the Buyer. Details are set out in the Refund & Withdrawal Policy.

ARTICLE 7 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Under Article 15 of the Distance Contracts Regulation, in addition to the other statutory exceptions, the right of withdrawal cannot be exercised for contracts for services performed instantly in electronic form or for intangible goods delivered instantly to the Buyer, for contracts for services whose performance begins with the Buyer's approval before the withdrawal period expires, and for contracts for goods prepared in line with the Buyer's requests or personal needs.

For products marked on the product page as delivered instantly, the Buyer, before the payment form opens, ticks a separate checkbox to accept that performance begins immediately with their approval and that they will therefore lose the right of withdrawal; the time of this approval is stored in the order record. For a service not marked as delivered instantly, starting performance before the withdrawal period expires requires the Buyer's separate explicit approval. Even where there is no right of withdrawal, the Buyer's statutory rights concerning defective goods and defective services remain reserved.

ARTICLE 8 – CONSUMERS RESIDENT OUTSIDE TURKEY

If the Buyer is a consumer resident outside Turkey, the protection given by the mandatory consumer protection provisions of their country of residence remains reserved. For consumers resident in a member state of the European Union or the European Economic Area, the conditions under which the right of withdrawal ends for digital content and services, the proportionate amount payable for partly performed services and the rights concerning conformity with the contract apply as described in section 9 of the Pre-Contract Information Form.

ARTICLE 9 – OTHER OBLIGATIONS OF THE PARTIES

The Seller is responsible for the product or service conforming to the characteristics stated at the time of the order, for delivery and for support, and responds to requests about the product or service via info@oguzhanarslan.com. Determining, declaring and paying the taxes on the products and services is the Seller's responsibility.

Unless the product page states otherwise, purchased digital content is provided to the Buyer for personal use as a non-transferable, non-exclusive right of use for the access period stated on the product page. The Buyer provides an accurate email address of their own in the payment form and uses the digital content, access details or service provided within this scope of use.

ARTICLE 10 – PERSONAL DATA

Personal data processed in connection with the order is processed for the purposes and on the legal grounds described in the Privacy Policy.

ARTICLE 11 – GOVERNING LAW AND DISPUTE RESOLUTION

This agreement is governed by the laws of the Republic of Turkey; the mandatory provisions referred to in Article 8 remain reserved. Disputes fall, within the monetary limits redetermined each year, under the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) at the Buyer's place of residence or where the consumer transaction took place; disputes exceeding these limits fall under the Consumer Courts (Tüketici Mahkemeleri), subject to first applying to mediation under Article 73/A of Law No. 6502. A claim before the Consumer Court may also be filed at the Buyer's place of residence. Consumers resident outside Turkey may also apply to the courts of their place of residence.

ARTICLE 12 – CONCLUSION, STORAGE AND ACCESS

Before the payment form opens, the Buyer confirms electronically, by ticking the relevant checkbox, that they have read and approve the Pre-Contract Information Form and this agreement; an order cannot be placed without this confirmation. The agreement is concluded and enters into force when the payment is completed after this confirmation. The order number created in the payment step does not by itself conclude the agreement; once concluded, the agreement is identified by that number.

The time of approval and the order details are stored by the Seller in the order record together with the order number; the version of the texts approved at that time is archived unchanged and kept for at least three years. This agreement is available in the legal documents section at https://oguzhanarslan.com. With the “Download documents” button next to the checkboxes, in the order summary above the payment form and on the return screen after the payment, the Buyer can download this agreement, the Pre-Contract Information Form and the Refund & Withdrawal Policy together with the order summary as a single HTML file, and store and print it; once the order is created, the downloaded file contains the version archived with the order, which is the one the Buyer accepted. The documents are not sent automatically by email; at the Buyer's request, the Seller sends the documents for the order by email.

This text is published in Turkish and English. If the two versions differ, the Turkish version prevails; this does not limit the rights a consumer has under the mandatory provisions of the law of their place of residence or the principle that unclear terms are interpreted in the consumer's favour.
